As an advocate for tenants' rights, Dave has voiced concerns about the Omaha Housing Authority's eviction practices, particularly its pursuit of small debts owed by tenants. He represented the Corrigan Neighborhood Association and Individuals in a lawsuit aiming to prevent the sale of the Corrigan Senior Center to LM&F Investments.
Tenant law attorney provides insight on legal options for residents at City View Apartments
Health and safety concerns have been raised after conditions at City View Apartments were brought to the attention of the city, and it’s because of those issues that local attorney Dave Pantos said residents could possibly get out of their lease for free.
Dave discussed the legal rights that tenants are entitled to in the context of poor living conditions. Tenants have the right to reach out to code enforcement, connect with a union, reach out to an attorney, and more. Legal Aid of Nebraska is another resource that can assist individuals who qualify.
Dave detailed what tenants can do in a fire scenario, advising tenants to understand their insurance, keep track of their belongings, and create a list of possessions that were lost. Even without insurance, tenants can file claims against the property owner if the premises were improperly maintained.

I was excited to see that the tenants of Fontenelle Hills Apartments in Bellevue voted to form the first tenants union in Nebraska to address their legitimate grievances regarding property management. I was interviewed by WOWT and Bella Caracta came to the office to interview me about the legal aspects of forming a tenants union. What’s clear is that Nebraska law prohibits a landlord from retaliating against a tenant or tenants for organizing a union. NRS 76-1439. What’s not clear is whether this is a trend and more unions will be formed. Watch this space…
